Terms and conditions for employers of locums

1. The word, 'Locum' in these terms and conditions refers to any employee recruited by AHSR to work for an Employer.

2. The word, 'Employer' in these terms and conditions refers to any person or organisation that undertakes to recruit staff through AHSR.

3. AHSR attempts to keep up to date with the requirements for Dental Board registration for each state. Occasionally, however, changes take place without our knowledge. AHSR accepts no responsibility where such a change results in a Locum no longer being registrable in a particular state or country.

4. AHSR tries to ensure Locums are provided with written confirmation and the details of their placement with the Employer. Where the Employer does not draft an employment contract or letter of confirmation AHSR may draft one and require it to be signed by both Locum and Employer. AHSR will not be liable for difficulties or damages arising from a contract or letter of confirmation so drafted.

5. Although AHSR endeavours to provide quality locums and match them well, the decision to employ rests solely with the Employer. AHSR will not be responsible for the Locums competence, character or suitability to the job.

6. AHSR accepts no responsibility for any cost, damage or loss to the Employer arising from any behaviour, action or failure by the locum.

7. The Employer shall not modify or extend any contract without first contacting and proceeding through AHSR.

8. The Employer shall not offer future work or refer the Locum to another Employer within 18 months of introduction, or the commencement of the most recent contract without first contacting and proceeding through AHSR

9. AHSR retains the right to refuse to provide or discontinue providing services to any Employer or potential Employer.

10. The Employer may be asked to provide an evaluation of the LocumÕs performance. Information so obtained will be used solely for the purposes of facilitating future placements and to ensure some measure of quality control.

11. The Employer acknowledges that the Locum may be asked to provide an evaluation of the placement. Information so obtained will be used solely for the purposes of facilitating future placements and to ensure some measure of quality control.

12. In the event of early termination of the contract (except when solely instigated by the Locum or by mutual agreement between the Locum and the Employer), a penalty of 50% of the expected commission will be payable to AHSR. This applies regardless of whether the term of the intended contract has actually commenced.

13. NSW legislation now requires all those working in the dental profession in that state that may potentially have unsupervised access to children be subject to a Working With Children Check. AHSR will attempt to undertake the checks and thus exempt you from needing to, however, it may not be possible in all situations. AHSR will not be responsible for any loss incurred if a Locum is found to be prohibited before or after commencing a contract. Please include a clause in all of your contracts to enable you to immediately and without penalty terminate those found to be prohibited under the Act. Where possible the checks should be done prior to commencement of employment.

14. By choosing to proceed through AHSR the Employer agrees to abide by AHSRÕs terms and conditions and fee schedule.

PAYMENT
Locums- are to be paid fortnightly and no more than two weeks in arrears by direct deposit into their bank account, by cheque, or as agreed to by Employer and Locum.

AHSR- an invoice will be sent by email, letter or fax at the commencement of term of placement. Terms 30 days. Overseas Employers are to pay by bank draft made out in Australian dollars to AHSR or by direct deposit into the AHSR account.
